UPDATE ON LEGAL PLAN COVERAGE AND DUES INFORMATION:

The FOP is proud to be the new bargaining agent for the Deputies, Corporals and Sergeants of the Orange County Sheriff's Office.  Our legal plan provides you with the best possible coverage.  There are no limits to the coverage.  There is a built in review to make sure that your dues are being spent wisely however NO FOP member has ever been denied coverage for any actions taken in the performance of their duties.  Can the PBA say the same?

The election is over, we won.  PBA members you are welcome to join the FOP and receive the first rate coverage you deserve.  Also the recent e-mail that went out from the PBA stated the FOP dues were significantly more than the PBA.  Our dues are $18.04 a pay period, which includes our legal, labor, fraternal and insurance coverage.  We also hold monthly dinner meetings where you can come and voice your opinion and have a vote on matters that affect you the most. Remember we are membership driven and you the members control the union not the board.

Make the right choice and join Orange County Sheriff’s Fraternal Order of Police Lodge 93.

FOP DUES INFORMATION & BENEFITS FOR ACTIVE (SWORN) OCSO MEMBERS

For all active (sworn) FOP members and new members. The dues for FOP members are $18.04 per pay period total.

Included in your dues are all fraternal benefits, our FOP unlimited legal defense plan, labor (collective bargaining) representation, a $30,000 feloniously killed in the line of duty death insurance benefit with a $10,000 accidental death and dismemberment insurance policy, and eligibility in our college scholarship program for your dependents.

Apparently the letter that went out from the FOP State Lodge caused some confusion. I can not use the agency e-mail system until next Tuesday so please pass this on to all active deputies, corporals and sergeants in your e-mail list.

THE FOP WINS ORANGE CNTY SHERIFF'S OFFICE DEP'S, CPL'S & SGT'S!

The deputies, corporals and sergeants have spoken and have chosen the FOP to represent them. I want to thank everyone who made this endeavor come true. It was a lot of hard work by a lot of people. Please take a moment to congratulate yourselves for a job well done. Thank you all again.

Now the hard part begins. Time to get to work. During this transition we will need help getting bargaining unit members to sign up for the FOP. We have printed out the necessary forms and will be mailing them to each bargaining unit member. Until you fill out and return the forms you are not covered. Don’t go unprotected!

We will be holding our monthly meeting this Tuesday December 13th at the Elks Lodge 12 N. Primrose Dr. Dinner starting at 5:30pm and the meeting starting at 7:00pm. Just so I can let the Elks Lodge know how many to expect please RSVP to me at FOP93@yahoo.com if you are planning on attending.

There will be forms at the meeting so that you can sign up and join the lodge. If you are already a member then you will just need to sign a payroll deduction card.

Transition: The PBA has until 12-23-2011 to file an appeal of the election. If they do then PERC has 10 days to rule. The State FOP has already filed a motion to stop PBA’s dues so that will start either on 12-23-11 or 10 days later. The FOP State Labor Council has also filed a motion to Adopt and Administer the Current Contract until a new contract can be negotiated. This process can not start until April 2012. More on this later.

I plan on sending out the membership packages to the different sections, so if you want to help pass them out then let me know by sending me an e-mail to either my work Larry.Lockwood@ocfl.net or FOP93@yahoo.com Just let me know how many are in your section.

It is important that we sign up as many as possible. There is strength in numbers and you need to send a message to the administration that we are Strong and United.

Fellow Orange County Deputies, Corporals and Sergeants hope all of you had a good Thanksgiving Holiday.

I have been out of town for the past week and have not had access to Facebook, so have not been able to respond to the comments posted above.  I want to thank everyone for keeping this professional and not making it personal.  In the end we are all Orange County Deputy Sheriff's.

To answer some of your questions.  NO we did not support Jerry Deming’s in the last election.  As a matter of fact the FOP came out almost two years before the election and supported John Tegg for Sheriff.  Much to the aggravation of then Sheriff Kevin Beary.  In the next election the membership will decide who the FOP endorses not you’re FOP Board.   As far as Jerry Deming’s wearing an FOP Pin he has been a member of the Orlando FOP for over 25 years.  That didn't stop FOP from negotiating contracts with him while he was Chief of the Orlando Police Department. On that note John Tegg has been a member of the FOP for almost 30 years.  Should we remove him from the membership just because he may become Sheriff of Orange County?  I think not.  The F in FOP stands for Fraternal and our by-laws allow all sworn Law Enforcement personnel to join the FOP. Members holding rank just have no voice or vote in any issues involving labor.

As far as the legal plan I believe we have provided you with more than enough information for you to make your decision.  You will have the best representation from the FOP.  At critical incidents you will have a staff representative, a highly trained lawyer and a member of the FOP Board of Directors.  You will also be represented for all discipline issues occurring in the scope of our duties including incidents occurring while working off duty that are law enforcement related.  There is no committee or board of directors who decide if you should be represented.  You will be covered.  I challenge the PBA to show one example of a FOP member who was not covered for actions occurring during the scope of their duties.  Can they do the same?  If the PBA representation so good why did the St. Cloud Police Department just vote to de-certify and kick out the PBA?   Oh and the big one.  Why did over 10,000 State Correction Officers and Probation Officers vote to kick out the PBA and voted in the Teamsters?

The question has been asked what the FOP can do different.  The FOP is a National Organization with over 350,000 members nationwide.  The Florida State Lodge has over 20,000 members and there are over 3,000 FOP members in the Central Florida area.  All of these members will be available to assist us in our negotiations and other efforts.  The FOP State Labor Board will bring seasoned staff representatives who will be negotiating on your behalf and have No Personal Agenda’s.   The FOP has many examples of their successes from around the state of Florida, so I encourage you to go to the WWW.Floridastatefop.org and educate yourself on the many FOP triumphs.  The FOP is membership driven and will be controlled by you not your leadership.  And on that note if you don’t like your leadership you get a chance to vote on that leadership at regular scheduled elections.

The lodge has established a Facebook page. Please go to Orange County Sheriff's Fraternal Order of Police #93 and feel free to add your comments. This is a chance for you to voice your opinion and help the lodge win this election.

The bottom line is that you have only about ten days left to get your ballot in the mail.  So educate yourself and make your vote count.

LIES, LIES, LIES! The last breath of a dying organization desperately trying to divert the attention away from their numerous failures in representing the Deputies, Corporals and Sergeants of Orange County Sheriff’s Office.

            The most recent flyer put out by the other union misquotes and takes fragments from the FOP Legal Defense Manual in an attempt to portray the FOP as putting limits on the legal representation afforded its members. See for yourself what the manual ACTUALLY says because the FOP is not afraid to put the whole manual on line, all 21 pages. On the other hand, the web site that the other union gives is a two page snippet so vague that one would wonder why over 400 hundred of your Brothers and Sisters signed cards to get rid of that other union if they had confidence in their legal plan.

            The FOP was the only Union in the state of Florida to file a lawsuit preventing furloughs from being imposed upon a neighboring agency. Again, the FOP was the only Union to wage a five year battle against the Sheriff in Pasco County regarding the “legislative body” issue. By winning that case in the First District Court of Appeal (the Supreme Court denied the Sheriff’s appeal), all contract impasse disputes will now be decided by the County Commission and not by any Sheriff. In Orange County alone, the FOP expended over $130,000 in legal fees to fight to hold the Sheriff to his promise of health care for life. Does this sound like a Union that is hesitant to represent its members to the fullest? Where was that other union when the hard issues needed to be fought? 

            The caps mentioned by the other union are in place to monitor expenditures to protect your dues. They allow for review and not denial as no one can name a single member that was not afforded full legal representation. With all the attacks on unions today, it is important that your dues are fully accounted for.

                If you select the Florida State Lodge Fraternal Order of Police to represent you, then you will have access to a full time professional Staff Representative, who is not an employee of the Orange County Sheriff’s Office, so he can’t be controlled by the Sheriff and doesn’t have a personal agenda.

            If you want the best representation, the best access to a full time staff representative, and access to the best lawyers who are not afraid to fight the hard battles, vote for the ONLY plan that provides you with an actual defense!

The time is near...time for a new union leadership...
 
Please make sure you spread the word about voting in the upcoming union election at the Sheriff's Office.  The election will come down to the FOP vs. CFPBA.  Make sure you encourage everyone you know to vote in that election.  We need to make a change in the atmosphere in the union leadership.  We need to give the FOP a chance at changing the culture of deception at the current union leadership.  The CFPBA is spreading deception as a ploy to scare deputies, corporals, and sergeants into keeping them in power.  Desperate times call for desperate measures. 
 
The FOP leadership and state labor negotiators are ready to negotiate on your behalf.  They have recenly hired Mr. Jeff Williams (FOP lead negotiator during the rise of the OPD contracts) and Mr. David Bigney (Attorney for FOP Members and OPD Officers involved in criminal, disciplinary, and critical incident investigations).  Talk to OPD Officers you know and ask them about Mr. Bigney and Mr. Williams.  Mr. Bigney used to be at the scenes of critical incidents faster than the PSD/Homicide investigators.  Just ask around...their reputation speaks for itself.
 
The FOP has legal protection for every member.  The limit on the defense during criminal and internal investigations is limitless.  The amount during civil suits, not covered by the agency, is set at $20,000.00.  Anything above $20,000 is discussed by the leadership of the FOP State Labor Board for allocation of additional funding.  There is no vote, there is no committee, it is just an oversight to make sure that the legal defense dollars are being spent wisely.  Don't let the PBA scare you...The FOP is upfront about their discussions and post everything online.  The CFPBA operates in the shadows and don't tell you they are doing the same thing on civil suits as well.  The entire legal policy for members for the FOP is on their website. 
 
Please take the time to spread the word, forward this letter and email, and educate yourself.  If you want a union that works on behalf of its members and operates in the sunshine where everyone can see and participate, VOTE FOR THE FOP.

A Word From Our General Counsel, Anthony Livoti Jr.

As many of you are aware, two years ago the FOP was the ONLY union in the state of Florida that initially challenged furloughs. The City of Palm Bay furloughed 28 Officers for two days using the "financial urgency" provision of 447. With the help of our Brothers and Sisters in Maryland, along with some direction from the National FOP, I filed a "first impression" lawsuit to prevent further action by the City and to make the affected Officers whole. After two years, I am happy to say that with the help of George Hachigian, the General Counsel's Chief of Staff, that suit was settled today. The Officers will be credited with the time lost.

While many units are experiencing difficulties in this troubling financial environment, it is important that we maintain a cohesiveness regarding the threats to pensions, wages and bargained for benefits. With the recent successes in Pasco County and Palm Bay, it is clear that these can be used as a beacon to encourage our membership that with a strong union behind them, we can continue to strive for a better working environment.

FLORIDA STATE LODGE JOINS LAWSUIT AGAINST GOVERNOR SCOTT!

 Brothers and Sisters,

Since the conclusion of the 2011 Legislative Session, we have continued to work with our labor coalition partners.  In a move to halt the implementation of Senate Bill 2100 and stop the confiscation of 3% of our FRS members pay, the Florida State Lodge has joined with the Teachers union and other state workers in filling a law suit/injunction against Governor Scott in Leon County today.

Through attorney Ron Meyer of Meyer and Brooks, working with our FOP General Counsel Tony Livoti, two FOP members are named as plaintiffs in the original law suit.  Our members, Lori Goodwin and Adam Teichner of Santa Rosa FOP Lodge 123 stood up for all law enforcement in the Florida Retirement System who are now being forced to submit to a 3% pay cut in order for the state to balance their bloated budget.  We will fight against this unconstitutional and unfair tax on our members.  Even as news this week comes out that the Florida Retirement System is in even better health than the legislators reported, our FRS members and state workers are forced to shoulder a burden they do not deserve.
